Apex Court says in History Judgement : Voters have right to reject all candidates contesting polls

In a landmark judgement, the Supreme Court gave the citizens of India the right to reject all candidates in elections.

Hearing a petition filed by the People's Union for Civil Liberties, an NGO, the apex court ruled that the Electronic Voting Machines or EVMs should have a button that will allow the voters to choose "none of the above" option.

The bench of Chief Justice P Sathasivam, Justice Ranjana Prakash Desai and Justice Ranjan Gogoi said that voters should be allowed to reject all candidates standing in an election in his/her constituency.

"Negative voting would foster purity and vibrancy in elections," the court said.

"Negative voting would lead to systemic change in polls and political parties will be forced to project clean candidates," the bench added.

"If right to vote is statutory right, right to reject candidate is fundamental right of speech and expression under Constitution," the court stated further.

The judgement will be implemented immediately, and the "none of the above" option will be included in EVMs and ballot papers to be used in the upcoming state Assembly Elections later this year.
The SC has also instructed the Election Commission to spread the message among voters.

While the judgement is historic, it will have little impact on the outcome of an election as negative votes will only be recorded on EVMs but not counted.

Prime Minister Approves the Constitution of Seventh Central Pay Commission

Conratulation to all central government employees as the Finance Minister Shri P.Chidambaram in a statement told today that the Prime Minister has approved the constitution of the Seventh Central Pay Commission.

The fourth, fifth and sixth Central Pay Commissions’ recommendations were implemented as follows:

4th CPC                       1.1.1986
5th CPC                       1.1.1996
6th CPC                       1.1.2006

The average time taken by a Pay Commission to submit its recommendations has been about two years.  Accordingly, allowing about two years for the 7th CPC to submit its report, the recommendations are likely to be implemented with effect from 1.1.2016.

Enhancement of ceiling for calculation of ex-gratia bonus payable to Gramin Dak Sevaks

The Union Cabinet today approved the proposal of the Department of Posts to enhance the ceiling for calculation of ex-gratia bonus payable to Gramin Dak Sevaks from Rs. 2,500/- to Rs.3,500/- same as that prescribed for the regular departmental employees. The decision would be applicable with prospective effect that is from the accounting year 2012-13 payable in 2013-14.

Look what is going on in Parliament: Cabinet likely to consider ordinance to protect lawmakers

The government is likely to consider an ordinance to protect convicted MPs and MLAs from facing immediate disqualification after having failed to get a bill to this effect passed in Parliament.

With Parliament not being able to pass a law to negate a Supreme Court verdict, lawmakers convicted in criminal cases with imprisonment of two years or more face the prospect of immediate disqualification.

The government had recently introduced the Representation of the People (Second Amendment) Bill, 2013 in Rajya Sabha to overturn the Supreme Court judgement that lawmakers convicted of crimes with punishment of two years or more face immediate disqualification.

Supreme Court Direction ; Aadhaar cards cannot be made mandatory for gas connections

In an epochal development, the Supreme Court on Monday clarified that Aadhar cards are not essential even as central and state governments insist on making it compulsory for a range of formalities, including marriage registration, disbursal of salaries and provident fund among other public services.

A bench of Justices BS Chauhan and SA Bobde said, "The Centre and state governments must not insist on Aadhar cards from citizens before providing them essential services."

The apex court also directed the central and the state governments not to issue the Aadhar cards to illegal immigrants.

The apex court passed the order in response to a PIL pleading it to examine the "voluntary" nature of the Aadhaar cards. The PIL was filed by Justice KS Puttaswamy, a retired judge of the Karnataka High Court recently.

Latest on Right to Information (Amendment) Bill 2013 : Parliament panel seeks people's view on RTI Amendment Bill

A Parliamentary Committee has sought people's suggestion on RTI Amendment Bill which is aimed at giving immunity to political parties from providing information.

The Right to Information (Amendment) Bill 2013 was introduced on August 12 in the Lok Sabha by Minister of State for Personnel, Public Grievances and Pensions V Narayanasamy. It was referred to Parliamentary Standing Committee on Personnel, Public Grievances, Law and Justice headed by Rajya Sabha MP Shantaram Naik.

The bill intends to amend the Act to keep the political parties out of the purview of the RTI Act, with a view to remove the adverse effects of the decision of the Central Information Commission dated June 3, 2013 which has held that six political parties are public authorities under the transparency law, said an advertisement seeking people's view or suggestion in this regard.

Wrong way to frame questions
One must not ask general or open-ended questions which are liable to be rejected outright. One should not ask 'reasons' for a decision.
E.g. do not ask "Why are the pits of roads of Manish Nagar not filled or repaired?" Such a question cannot be answered in a single way and it could be answered in both a few lines or even few pages giving whole history of the particular road, area, budget, contractors, who did what and what not, why things did not happen the way they were supposed to be , and so on. Still that response may not be of any relevance to applicant and will waste time of PIO also.

Also, do not ask question like "What are the reasons for not filling the pits of roads of Manish Nagar?". It is again an open ended question. So one must avoid all questions which start with “Wh….”.

Right way to frame questions

The questions should be framed asking for yes/no or a specific data record, number etc. E.g.
1. Is there a budget allocation for filling the pits of roads in Manish Nagar for F.Y. 2013-14? This can be answered by a simple Yes/No.

2. How much is the budget for road repairs in FY 2013-14 for Manish Nagar? This can be answered based on budget and finance data held with Municipality.

3. By when are road repairs planned if any? If road repairs are not planned, the PIO can answer it as NIL. If they are planned, the PIO has to give information about dates etc.

4. By when will tenders for road repairs be conducted? Again this can be answered based on data and records held by municipality.

            The Confederation Secretariat met at Delhi on 19.9.2013 and decided to change the dates for the Strike Ballot to 11, 12& 13 November, 2013 and to undertake massive campaign programme prelude to the strike ballot.  The date for conducting the same in the ITEF will be communicated after the ensuing Secretariat Meeting on 27th September, 2013.

            In the name of austerity measures, the Govt. has decided and notified complete ban on creation of Posts and filling up of vacancies once again.  Even the filling up of existing vacancies that are lying vacant for various reasons for more than a year is also brought under the ambit of the orders issued on 18.9.2013.  The Confederation has decided to oppose the retrograde steps of the Government by organising massive protest demonstration in front of all office on 25th September, 2013.  Since we are in the process of allocation and filling up of the posts sanctioned by the Cabinet under Cadre Restructuring, it is far more important for us to resist such moves with all force at our command. All the Circle General Secretaries are requested to carry out Lunch hour demonstration in front of IT Offices or in a common place along with other organisations participating in the Confederation. The Circular No. 7 of the Confederation issued on 20.09.2013 is attached.

            Cadre restructuring and its implementation:  The various Sub-committees constituted by the Board to suggest the method of implementation are yet to finalise their report.  The One committee which has submitted their report (Committee for merger of Directorate) has totally rejected our views in this regard.  The committee did not even consider to record and provide the minutes of the meetings.  The matter has been brought to the notice of the Chairperson and Member (P&V) today, who have assured us to look into the matter and amicable settlement.  The Committee looking after the Allocation of posts and Jurisdiction also indicated different yardstick for allocation and jurisdiction.  Our stand with further justifications has again been placed before the committee which is reconsidering all aspect in this regard and assured due consideration of our views before finalisation of the report.

10% hike in DA approved : Now 90% DA

The Union Cabinet today approved the proposal to release an additional installment of Dearness Allowance (DA) to Central Government employees and Dearness Relief (DR) to pensioners with effect from 01.07.2013, in cash, at the rate of 10 per cent increase over the existing rate of 80 per cent.
Hence, the Central Government employees as well as the pensioners are entitled for DA/DR at the rate of 90 per cent of the basic with effect from 01.07.2013. The increase is in accordance with the accepted formula based on the recommendations of the 6th Central Pay Commission.

The combined impact on the exchequer on account of both dearness allowance and dearness relief would be of the order of Rs. 10879.60 crore per annum and Rs. 7253.10 crore in the financial year 2013-14 ( i.e. for a period of 8 month from July, 2013 to February 2014).

UPA government is set to hike the dearness allowance (DA) of its employees by 10%

Ahead of the festive season, the UPA government is set to hike the dearness allowance (DA) of its employees by 10%, a move that will benefit almost 8 million people by boosting their purchasing power. 

The Union cabinet will consider a proposal on the raising the allowance, which is a proportion of basic pay, at its meeting on Friday.

In what can be seen as major sop for a large section of aam aadmi, this will be the second DA hike in a financial year. More importantly, also ahead of the 2014 general elections.

Postal Department to bring RTI Stamp soon......

RTI applicants will no longer have to wait to get their applications processed as the Department of Posts is all set to bring out an RTI stamp for sale soon and also set up special counters, according to a senior officer.

"Under orders of the Central Information Commission, the department will issue RTI stamps in the denomination of Rs 10. We will also introduce special counters to accept applications in all 1.5 lakh post offices across the country," the officer speaking on condition of anonymity, told a news agency.

Over 75% of the funding received by political parties is from unknown donors.

This flies in the face of claims made by parties that details of their financial statements are in the public domain.

According to data analyzed by Association for Democratic Reforms (ADR), the total funds received by six national political parties between 2004-2005 and 2011-2012 was Rs 4,895.96 crore of which only 8.9% was from known donors. Around Rs 3,674.50 crore or 75.5% were anonymous contributions. Parties also generate funds from sale of coupons and donations from electoral trusts.

Parties including Congress, BJP, NCP, CPI, CPM and BSP's financial statements submitted to the Election Commission and income tax returns were analyzed by ADR. Congress tops the parties for the largest amount (Rs 1,951.07 crore or 82.5%) in anonymous donations. NCP boasted of the largest proportion of unknown donations at Rs 181.48 crore or 91.58%. About 73% of BJP's contributors and 61.8% of BSP's donors were unknown.

The data has also revealed that an overwhelming majority of political donations were in cash. Congress accepted 90.38% of its total funds between 2008 and 2012 in cash and only 9.62% were in cheque. Over 67% of BJP's total funds were in cash while 83% of NCP's were in cash.

Describing political parties' financial details as under a "veil'', ADR founder member Jagdeep Chhokar said, "The public has no idea about where three-fourths of the funding of political parties comes from. There is complete opacity. That is why it is necessary that RTI Act not be amended.'' The NGO working on electoral reforms has sought complete transparency in donations.

2. The Number of vacancies and eligible officials against the promotion quota at each level.

GST Bill may come up in winter session of Parliament

The goods and services tax (GST) Bill will be taken up in the winter session of Parliament, Union minister of state for finance J.D. Seelam said on Wednesday.

“There is near-consensus between the finance minister and the chairman of the empowered committee of states’ finance ministers. We can table it (the Bill) during the winter session,” Seelam told reporters on the sidelines of a Federation of Andhra Pradesh Chamber of Commerce and Industry (FAPCCI) event in Hyderabad.
India is trying to bring in legislation for a unified market by implementing a simple goods and services tax (GST).

IRCTC Launches New APP for Windows Phone and Windows 8 Devices to Provide Alternative Channel for Booking E-Ticket

In its continuing efforts to enhance access to its popular e-ticket portal, Indian Railway Catering & Tourism Corporation Ltd. (IRCTC), a Public Sector undertaking of the Ministry of Railways, has launched a new application (App) for Windows Phone and Windows 8 devices so as to facilitate the users with a new channel of booking e-tickets in addition to the existing portal. This new IRCTC-App, which has been launched in collaboration with Microsoft, provides ANYTIME, ANYWHERE access to IRCTC services.

Payment of Quarterly Advance Tax on or before 15th September, 2013; All Designated Branches of Authorized Banks to Function on 14th and 15th September, 2013 (Saturday & Sunday)

 All designated branches of authorized banks have been asked to function on 14th and 15th September, 2013 (Saturday & Sunday) to accept advance tax payments. If any tax payer fails to pay the advance tax on 14th/15th September, 2013, then he/she can make the payment even on 16th September, 2013.

Payment of Quarterly Advance Tax on or before 15th September, 2013 by the tax payers is a statutory requirement. All such tax payers who are liable to pay advance tax must make payments in the designated branches of the banks authorized to accept tax payments.

Notification for Extension of date for receipt of ITR-Vs in CPC, Bengaluru. for the cases of AY 2012-13 and 2O11-12 received in e-filed in FY 2012-13.

There are many taxpayers who have uploaded their Income Tax Returns electronically (without digital signature Certificate) for A.Y. 2O11-12 [filed during F.Y. 2O12-13 and for ITRs of A.Y. 2O12-13 [filed on or after 1.4,2012], but have either not filed the corresponding ITR-V or have filed it with the local Income-tax office. ITR-V is accepted only at the Centralized Processing Center (CPC) of the Income-tax Department at Bengaluru by ordinary or speed post. Therefore, a final opportunity is being given to such taxpayers to regularize their Income-tax returns. All such taxpayers may mail the ITR-V, by 31st  October, 2O13, by ordinary post or speed post at Post Bag No. 1, Electronic City Post Office, Bengaluru - 560100 (Karnataka). Taxpayers who have filed their ITR-V with the local Income-tax office may again mail their ITR-V to the CPC by 31st October, 2013. Those taxpayers who have earlier mailed their ITR-V, but have not received the acknowledgement e-mail from the CPC, may mail their ITR-V to the CPC again.

Railway Revenue Earnings up by 10.29 Per Cent During April - August 2013

The total approximate earnings of Indian Railways on originating basis during 1st April to 31st August 2013 were Rs. 54462.79 crore compared to Rs. 49382.94 crore during the same period last year, registering an increase of 10.29 per cent.

The total goods earnings have gone up from Rs. 34067.51 crore during 1st April – 31st August 2012 to Rs. 37085.96 crore during 1st April – 31st August 2013, registering an increase of 8.86 per cent.

The total passenger revenue earnings during 1st April – 31st August 2013 were Rs. 14758.00 crore compared to Rs. 13005.37 crore during the same period last year, registering an increase of 13.48 per cent.

The approximate revenue earnings from other coaching amounted to Rs. 1560.67 crore during April - August 2013 compared to Rs. 1261.35 crore during the same period last year, an increase of 23.73 per cent.

The total approximate numbers of passengers booked during 1st April– 31st August 2013 were 3533.86 million compared to 3566.83 million during the same period last year, showing a decrease of 0.92 per cent. In the suburban and non-suburban sectors, the numbers of passengers booked during April-August 2013 were 1883.14 million and 1650.72 million compared to 1840.18 million and 1726.55 million during the same period last year, showing an increase of 2.33 per cent and a decrease of 4.40 per cent respectively.

Personal details cannot be disclosed under RTI: Bombay High Court

Under RTI, disclosure of personal information in respect of service record, income tax returns and assets of an individual is illegal unless it is necessary in larger public interest, the Bombay High Court has ruled.

Accordingly, Justice Vasanti Naik quashed an order of Nashik State Information Commissioner asking the information officer to supply information about personal assets of petitioner Subhash Khemnar to respondent Dilip Thorat.

"On hearing the petitioner and on perusal of the Act, it appears that the Chief Information Commissioner was not justified in directing Information Officer to supply personal information in respect of service record, income tax returns and assets of the petitioner unless he was satisfied that such disclosure was justified in larger public interest," said the judge in a recent order.
