As it is well known that the income tax department has allowed Aadhaar card holders to use the biometric id number in lieu of the Permanent Account Number (PAN). But as per new provision of Income Tax, fine of Rs. 10,000 may be levied in case of wrong Aadhar Number. As per the latest amendments in the Finance Bill 2019, not only allowed people to use Aadhaar in lieu of PAN but also introduced a penalty for giving a false Aadhaar number. However, the new penalty rules are applicable only in cases where you are using Aadhaar in lieu of PAN and where quoting PAN is mandatory according to the income tax department rules. It is well known that although Aadhaar is issued by the Unique Identity Authority of India, yet the fine is not imposed by UIDAI but by the income tax department. Under Section 272B of the Income Tax Act, 1961, the department can impose a penalty in case of default in complying with provisions relating to PAN, i.e., failure to obtain, quote, or authenticate PAN.
Implementation of Cadre Restructuring of Income Tax Department: Minutes of Meeting held on 5th July 2013
CBDT today published the minutes of the meetings of implementation
of Cadre Restructuring of Income Tax Department held at New Delhi on 5th
July, 2013. Main points are as under:
· 1. CIT(CCA)
must necessarily involve employees of Gr. A, Gr. B and Gr. C of the department,
after consulting with IRS Association, ITGOA and ITEF, for constituting
appropriate implementation committees for examining and formulating their
recommendation.
· 2. All
due efforts should be made to complete the restructuring entirely in the calendar
year
3. There
should be an effort to create Income Tax Office
in every district of India while drawing up the implementation plan for
restructuring.
4. The
imperative for higher revenue collection (of additional revenue collection of
Rs. 25,756 Crores per annum) viz a viz cadre restructuring and attendant
creation of new posts in the department. The CBDT is committed to deliver on
the revenue collection.
· 5. Where
flexibility for distribution of post is possible, there should be keeping in
view, inter alia, the various factors like workload, revenue potential and
outcome of the recommendations of the various sub-committees set-up for the
purpose inter alia.
