Central government employee will be communicated through email.......

All Central government employees will soon be expected to communicate through the National Informatics Centre (NIC) email ID, a union minister said on Monday adding that the government was chalking out a plan in this regard.

Minister of State for Communications Milind Deora told reporters that his department is working on a new email policy which will address this issue, among others.

"Once this is ready, then all government officials will have to communicate only through NIC email id," he said.

"After this, the issue of cyber security can be addressed on a single platform as NIC is taking care of e-governance programmes of the Centre," said Deora.

Constitution of 7th Pay Commission in next couple of weeks..........

The central government is likely to constitute the 7th Pay Commission for revising the salaries of its over 50 lakh employees before the start of process of next general elections due in May, 2014.

"The Finance Ministry is working out a Cabinet proposal for constitution of the 7th Pay Commission which could be taken up for consideration in the next couple of weeks," a source said.

The Subcommittee No. 6 has submitted its report regarding recruitment rules. 

"As promotion to the post of Inspectors shall henceforth be only from Executive Assistants, the existing system of quotas in promotion for Ministerial Staff and Stenographers has become redundant and accordingly, has been done away with. For the same reason, for the existing provisions relating to quota for promotion on the basis of  seniority and date of passing has been deleted."

It is learnt that ITGOA has sent reports of all 7 sub committees to all the members nominated by association to these sub-committees by email. The association also requested to submit their detailed comments within 4 days i.e. whether the report is conforming to the suggestions of ITGOA or not. if not, what are the variations? The core committee will be submitting its reports shortly and board will call ITEF and ITGOA for discussion on these reports.

Circular of ITEF dated 13.12.2013 on Cadre Restructuring and other issues

Today ITEF issued a circular regarding Secretariat meeting held on 12.12.2013 on Cadre Restructuring, NR Parmar judgement and other issues. 

Cadre Restructuring : As stated by ITEF, the basis adopted for allocation of the posts by the sub-committee was not on a realistic basis and far from practicality.  ITEF further stated that the Committee has not accepted any of the parameters suggested by the federation.  The allocation made and submitted by ITEF on the basis of the formula adopted in the Working Committee Meeting was totally rejected by the Sub-Committee. Read related post on the matter :- Click here

Implementation of Cadre restructuring of Income Tax and NR Parmar case judgement

It is learnt that some members of the core committee and some associations are not happy with the report of sub-committee for allocation of posts and jurisdiction. This is the reason for delay in finalization of allocation of post and jurisdiction.

It is also learnt that next meeting of core committee is scheduled on Monday i.e. 16.12.2013. Therefore the final report may come after 16th December.

After finalization, all the DPC or revised DPC will be completed in a span of 40-45 days. 

The merging of all the feeder cadres for ITI will be finalized before promotions. The new recruitment rules will be released after the approval of competent authority i.e. DOPT. Meanwhile an executive order will be passed by the CBDT for implementation of cadre restructuring before the approval of DOPT.

In the case of implementation of NR Parmar's case judgement, it is decided by the board, associations and other relevant departments to go ahead with implementation of the Judgement in all the cadres. The Date of Requisition by the Department to the SSC is the criteria for considering the seniority of the DRs.

It is also learnt that the Board has assured that it will provide the necessary data required to all the Regions since 1986, for implementation on the Judgement.

No proposals for establishing new office of DGIT........: PIB

As per the press release published by Press Information Bureau there are no proposals for establishing news office of DGIT at various places. read full contents of press release below: 

"There are no proposals for establishing new offices of Director General of Income Tax at various places in the country. However, a new office of Director General of Income Tax for Data Mining and Risk Management has been sanctioned by the Government. 

To protect the interest of officers and staff of Income Tax Department the Government has approved the Cadre Restructuring proposal of the Income Tax Department and has continued with the scheme of grant incentive of 1% of the revenue collected by the Department in excess of the budget estimates. 

This was stated by Minister of State for Finance, Shri J.D. Seelam, in written reply to a question in the Lok Sabha today."

CCsIT are getting double promotion in terms of pay scale

As the information received, the awaited promotion of CsIT to CCsIT is supposed to bring double benefit for them. CsIT are getting now SAG pay scale. After getting promotion as CCIT they would get HAG+ instead of HAG scale. Orders of promotion may be issued any time.

7th Pay Commission News : Process to constitute the 7th CPC initiated...........

Process to Constitute the 7th Central Pay Commission Along with Finalization of Its Terms of Reference, The Composition and Time frame Initiated

The Government has initiated the process to constitute the 7th Central Pay Commission along with finalization of its Terms of Reference, the composition and the possible time frame for submission of its Report. The date of effect thereof will be known once the Report is available.

This was stated by Shri Namo Narain Meena, Minister of State in the Ministry of Finance in a written reply to a question in the Lok Sabha here today.

Key points regarding Cadre Restructuring of CBEC

As the cadre restructuring of CBEC is approved by Union Cabinet on 05.12.2013, here are some key points regarding Cadre Restructuring of CBEC:

1.      A total of 18,067 additional posts will be created. Out of this, 989 posts will be for Group ‘A’ officials such as Chief Commissioner, Commissioner and Assistant Commissioners. The remaining will be for Group B, C and other category consisting of Superintendents, Inspectors, Havaldars and field staffs. Currently, the sanctioned strength of CBEC is 66,808.

2.      It has also been decided to create 2,118 temporary posts for five years.

3.      The whole exercise is expected to be completed in the next two years.

4.    Creation of additional posts will involve an expenditure of approximately Rs 774 crore, it will help in collecting around Rs 68,000 crore annually.

Implementation of Cadre Restructuring of Income Tax: Discussion in Video Conference on 28.11.2013

Today Video Conference of CBDT with CCsIT and DGsIT has been held on scheduled time. All the predetermined issues including issue of Cadre Restructuring were discussed. CBDT informed that reports of all subcommittees except Subcommittee for allocation of posts and jurisdiction have been received. It is also informed that this subcommittee will submit the report tomorrow i.e. 29.11.2013.

Pay commission could be notified over the next two months

Sources said that the the pay commission could be notified over the next two months or so, well before the model code of conduct for the general elections kicks in. Also, the Center is expected to give the panel enough time to prepare its report in the hope that the government would be a lot more comfortable vis-a-vis the fiscal deficit by the time the panel submits its report.

Possible Terms of Reference (ToR) for the 7th Central Pay Commission

A meeting was held on 24.10.2013 at 3.00 PM in Committee Room No 190, North Block under the chairmanship of Dr S.K.Sarkar, Secretary DOP&T to discuss the possible Terms of Reference (ToR) for the 7th Central Pay Commission, which is going to be set up by the Government, with the representatives of the Staff Side of JCM.

New rule lowers HRA exemption claim limit..........

The central government has lowered the exemption limit for reporting the rent received. Salaried taxpayers claiming HRA exemption and paying a rent of over Rs 1 lakh per year have to give landlord's PAN (permanent account number). Till now, if the total rent paid was less than Rs 15,000 a month there was no need to submit the landlord's PAN details. The new rule effectively lowers the rent limit from Rs 15,000 a month to Rs 8,333 per month for claiming HRA exemption without making any disclosures.

Though incurring actual expenditure on payment of rent is a pre-requisite for claiming deduction under section 10(13A) of the I-Tax Act, it has been decided as an administrative measure that salaried employees drawing HRA up to Rs 3,000 per month will be exempted from production of rent receipt.

The new rule is aimed at people claiming HRA exemption for living in their own house. "It has to be noted that only the expenditure actually incurred on payment of rent in respect of residential accommodation occupied by the assessee subject to the limits laid down in Rule 2A, qualifies for exemption from income-tax," CBDT said in its circular.

HRA granted to an employee who is residing in a house/flat owned by him is not exempt from income-tax. "The disbursing authorities should satisfy themselves in this regard by insisting on production of evidence of actual payment of rent before excluding the house rent allowance or any portion thereof from the total income of the employee," CBDT said.

DTC Bill in Winter Session : Provision of Fourth slab may introduce.......

The finance ministry on Wednesday said it is finalizing the official amendments to the Direct Taxes Code (DTC) Bill so that it could be taken up in the winter session of Parliament beginning 5 December.

“We are working on the DTC Bill and want to bring it as soon as possible,” revenue secretary Sumit Bose said on the sidelines of a Confederation of Indian Industry (CII) summit.

The finance ministry is currently working on the official amendments to the DTC Bill which was tabled in Parliament earlier.

Current position of Cadre Restructuring of CBEC

      The cabinet note for cadre restructuring has been signed by the FM. It is expected to be placed before the cabinet on 21.11.13 or 28.11.13.

Income Tax exemption limit will be raised to 3 lakh, Introduction of Super rich Category

Well, Ministry of Law and Justice has approved the proposal to raise annual income tax exemption limit from 2 lakh to 3 lakh, reports DB correspondent.

The Direct Tax Code (DTC) draft will now be sent to Cabinet for approval. Thereafter, the approved draft will be introduced in Parliament. According to an official of Ministry of Finance, Parliamentary Committee has nearly agreed to the tax exemption limit under the latest draft of future DTC bill.

Objection raised by DOPT on Cadre Restructuring Proposal of CBEC : Financial Express

The Department of Personnel and Training (DoPT) has raised objections to the cadre restructuring proposal of the Central Board of Excise and Customs (CBEC), delaying a resolution to the acute manpower crisis affecting the indirect tax administration, which is struggling to collect 20% more revenue from central excise, customs and service tax this year from a year ago. CBEC has a revenue target of Rs 5.6 lakh crore this fiscal, 46% of the Centre's gross tax revenue.

The annual growth in indirect tax collections has come down sharply since 2011-12. It is reckoned that in addition to the economic slowdown, the CBEC's human resource crunch has also hit the collection drive. CBEC's demand for more secretary-level posts and field officers to bolster its revenue collection drive is now likely to be referred to a committee of secretaries or to a group of ministers for further review instead of being placed before the cabinet for approval as expected earlier.

With 68,000 personnel at different levels, CBEC has only two thirds of its sanctioned strength at present. The tax research unit (TRU), a vital part of the CBEC, has about 12 vacancies at the moment. Officers said vacancies that arise from retirement are not being filled because the cadre recast proposal aimed at adding another 20,000 personnel was under consideration.
“To meet the fiscal deficit target, it is desirable to raise revenue, not cut productive expenditure. If revenue collection lags, public borrowing goes up,” said a person familiar with the development. The Centre will borrow Rs 4.84 lakh crore (net) this fiscal.

What has triggered a review is DoPT's questions on the proposal to promote non-IRS officers at the fag end of their career to IRS rank. CBEC had suggested creating about 4,000 temporary assistant commissioner-level posts to be filled by way of promoting group B (non-IRS) officers from the rank below.
Sources told FE that DoPT has pushed for creating more temporary AC posts to be filled through promotions will distort the government of India service rule that 50:50 ratio has to be maintained between directly recruited IRS officers (through the UPSC) and officers promoted from the cadre below.

The proposal was made by the Sixth Pay Commission heeding to the demands of group B non-IRS officers such as superintendents who join the service as inspectors but get only one promotion in their long careers. To avoid stagnation, they wanted the chance to retire as an IRS officer at the level of assistant commissioner.

“If we do not go ahead with the proposal, promotions from group B to group A will get affected. It will affect the aspirations of our group B officers. It is a ticklish issue that has cropped up now. If it goes to a group of ministers, a decision might take longer,” said an official privy to the development, who also held the DoPT’s view as a valid one needing careful handling.

The development is set to delay further the cadre restructuring of CBEC in the wake of the forthcoming national polls ahead of which a model code of conduct will limit the government’s ability to finalise and implement it.

Cadre restructuring proposal for the income tax department has already been notified and delays in the same for CBEC has put the indirect tax administration at a disadvantage. Sources said chief commissioners in the I-T department in large zones are designated as special secretaries now, unlike their counterparts in CBEC.

Also, unlike in the case of CBDT cadre recast, the Cabinet Secretariat had demanded an assurance from CBEC that it would meet the revenue targets for the year. Many field officers believe linking revenue collection performance with the cadre review was unfair. They also point out that senior officials in CBEC get secretary rank after putting in many more years in service than their counterparts in other central services.

Expected DA from January 2014 may be increased by 11% for Central Govt. Employees & Pensioners

All-India CPI-IW for September, 2013 rose by 1 point and pegged at 238. According to this increase Dearness Allowance for Central Government Employees & Dearness Relief for CG Pensioner confirmed to be 100% from January, 2014. This increase and present economic scenario are making less possibility that the DA/DR for Jan, 2014 may not cross 100% or may stop at 99%. It is highly expected that DA from January 2014 may increase upto 10% to 11%.

            The Central Dearness Allowance is used to calculate with the help of last 12 months' All India consumer Price Index for Industrial Workers (AICPIN-IW). AICPIN-IW is declared by Labour Bureau  Deptt., Government of India. The month-wise AICPIN is listed below:-

 ITEF, ANDHRA PRADESH CIRCLE, HYDERABAD circulated following details on All-India Working Committee of the ITEF held at Jaipur on 19 & 20th October, 2013:

The following issues were discussed in the all-India Working Committee meeting of the ITEF held at Jaipur on 19th and 20th October 2013. It was stated that the sub-committee of CBDT has agreed upon the following issues which the ITEF has time and again demanded:

1. The sub-committee of CBDT on cadre-restructuring at all-India level has discussed the issue of conversion of staff car drivers into TA / NS and agreed in principle. Proposals will be sent for making modifications in the recruitment rules of TA and NS to this effect.

2. The sub-committee of CBDT is also actively considering the absorption of daily rated workers in the cadre restructuring exercise itself. A positive decision is expected because many new MTS posts will be created in cadre restructuring.

Charge-wise allocated strength in various grades in the income tax department as on 31.03.2009

There is no information received from any reliable sources regarding finalization of Region wise allocation of posts due to Cadre restructuring 2013 of Income tax department.

Only information received from the side of ITEF about the criteria for region wise distribution of posts. The ITEF is going to propose following criteria for distribution of posts: 

1.    Workload
2.   Revenue collection
3.   Stagnation
4.   Geographical Criteria or Muffasil.

Most of the proposals of ITEF with regard to Group ‘C’ cadre were accepted by the CBDT at the time of previous cadre restructuring of the department.

As process of implementation of cadre restructuring is on the way, many of visitors of ITian India are interested to know about the present allocation of various grades in the Income Tax Department. Following chart shows the Charge-wise sanctioned strength in various grades in the income tax department as on 31.03.2009. Visitors of ITian India are requested to point out the discrepancies found, if any, by commenting in comment box.
