New Income Tax Rules – Submission of false Aadhaar number may be fined Rs. 10,000

As it is well known that the income tax department has allowed Aadhaar card holders to use the biometric id number in lieu of the Permanent Account Number (PAN). But as per new provision of Income Tax, fine of Rs. 10,000 may be levied in case of wrong Aadhar Number. As per the latest amendments in the Finance Bill 2019, not only allowed people to use Aadhaar in lieu of PAN but also introduced a penalty for giving a false Aadhaar number. However, the new penalty rules are applicable only in cases where you are using Aadhaar in lieu of PAN and where quoting PAN is mandatory according to the income tax department rules. It is well known that although Aadhaar is issued by the Unique Identity Authority of India, yet the fine is not imposed by UIDAI but by the income tax department. Under Section 272B of the Income Tax Act, 1961, the department can impose a penalty in case of default in complying with provisions relating to PAN, i.e., failure to obtain, quote, or authenticate PAN.

Distribution of posts released

Congratulation to all employees of Income Tax family as CBDT finally released a order for distribution of posts in different cadre to different CCAs. Now it is expected that DPC  process for the promotion to all posts may be  initiated soon. However, detailed guideline is still awaited and the same may be issued any time. Promotion to Pr. CCIT finalized and Order of Deaness Allownce issued

Today, Chairman, CBDT issued a message and congratulated all the 18 officers who have been elevated   to the grade of Principal CCIT in the Apex scale of Rs.80000/-.   Chairman also conveyed this day  a Historic day for the Income Tax Department. It is expected that the notification for implementation may be issued before 31.03.2014. View the ITEF Circular here . Order for revised rate of DA released. Dearness Allowance payable to Central Government employees shall be enhanced from the existing rate of 90% to 100% with effect from 1st January, 2014. The additional installment of Dearness Allowance payable under these orders shall be paid in cash to all Central Government employees. The payment of arrears of Dearness Allowance shall not be made before the date of disbursement of salary of March, 2014.  View the Order here.

ITEF's new circular on CR and other issues

The ITEF issued a circular after the meeting of PGRC which was held on 25th March, 2014 as scheduled. The outcome of the meeting on some of the agenda items is as under: Cadre Restructuring : On the matter of Cadre Restructuring it is informed that there will not be reduction of posts in any charge and all charges will get the entitled additional posts. The proposal is now awaiting the final approval of the Finance Minister and in all probabilities the same will be notified by 31st March 2014. Status of Cadre Restructuring of IT and Dearness Allowance

As Finance Minister is currently out of the country and scheduled to return the capital tomorrow, the file related to Cadre restructuring of Income Tax may be placed on tomorrow or day after tomorrow. The notification in this regard may be issued soon. On the other hand, all employees are eagerly waiting for Finance Ministry's Memorandum regarding revised dearness allowance w.e.f. January 2014 and the March month is going to its end. It is pertinent to mention here that in the last year, the approval for enhancement of DA was issued on 18th April.

Agitation of ITEF, Delhi Circle Postponed

After announcement of agitational program on the matter of implementation of Cadre Restructuring of Income Tax Department, now the JCA Delhi has decided to withhold the agitation starting from 19.3.2014 till further information. Like ITian India on Facebook As per the information gathered,  the Member (P & V), CBDT has called the ITEF, Delhi Circle to meet and discuss the matter on 18.3.2013. In the meeting she has intimated that official meeting with the Secretary (Revenue) has been fixed for 19.3.2014 and assured that the Board is making all out efforts to expedite the implementation of the Cadre Restructuring and requested to postpone the agitation till the outcome of the said presentation with the Revenue Secretary. It is also informed that t he assurance given by the Member (P & V), CBDT is conveyed in writing to the ITEF, Delhi Circle through the office of the CCIT (CCA), New Delhi. ITEF Delhi Circle is on the way of agitation

A General Body meeting of the INCOME-TAX EMPLOYEES FEDERATION, DELHI CIRCLE & INCOME-TAX EMPLOYEES FEDERATION, 'Gr. D 'DELHI CIRCLE, NEW DELHI was held on today i.e. 14.3.2014 during lunch hour to chalk out the agitational programme on the issue of Cadre Restructuring implementation. In the meeting it has unanimously been resolved that if the notification of posts allocation will not be issued before 19th March 2014 the following agitational programme would be embark upon wef 03/19/2014: 1. Walkout from 12.00 PM onwards on 19.3.2014. Like ITian India on Facebook 2.Mass Dharna at C.R. Building w.e.f. 11.00AM on 20.3.2014 to 5.00 PM on 21.3.2014. 3.It has been further resolved that if no action in this regard has been taken till 21st March 2014, then the General Body Meeting of the ITEF, Delhi Circle will again be called on 21.3.2014 to review and accelerate the agitational programme by adopting measures like hunger strike or indefinite strike etc.

ITGOA wrote letter to CBDT to issue uniform guidelines in NR Parmar case

ITGOA wrote letter to CBDT pressing for issuance of a guidelines for uniform implementation  of  Hon'ble Supreme Court's judgement in the case of Union of India Vs. N. R. Parmar and DOPT's O.M dated 04.03.2014,  across the various charges in order to remove the anomaly that exists in various charges in the seniority list of Inspector of Income Tax. This has become necessary for conducting the review DPCs in cadres of Income-tax Officers to determine relative seniority at National level and also to reduce the ongoing litigation as well as future litigation. ITGOA in its letter also stated that there is urgent need to attend this problem as the promotions in all cadres are stayed by judicial authorities, which is jeopardizing the career prospects of the members of the Association. AIRF writes for enhancement in the rates of various allowances by 25% consequent upon DA crossing 100%

All India Railwaymen's Federation (AIRF) has sent a letter to the secretary(E), Railway board regarding e nhancement in the rates of various allowances by 25% consequent upon DA crossing 100%. Read the contents of letter here: "The VI CPC in their report had recommended that certain allowances, viz. Children Education Allowance, National Holiday Allowance, Daily Allowance, Washing Allowance, Breakdown Allowance, Special Compensatory Allowance, Cycle Maintenance Allowance, Fixed Conveyance Allowance, Road Mileage Allowance, Special Allowance to various categories of staff etc. etc., should be increased by 25% whenever Dearness Allowance crosses 50%, and this recommendation was duly accepted by the Government of India. Like ITian India on Facebook Based on the above recommendation of the VI CPC, these allowances have since been enhanced by 25% w.e.f. 01.01.2011, i.e. from the date, Dearness Allowance having been crossed 50%. ITGOA's Circular on development on various issues after meeting with the authorities in the CBDT and meeting with ITEF

The newly elected CHQ of ITGOA met the DGIT and other authorities in HRD on 04/03/2014 and met the Chairman, Member(P) and other authorities in the CBDT on 05/03/2014 and discussed on following issues 1.         Issue relating to placement of 2001 batch in NFSG 2.         Promotion from ITO to the ACIT cadre :  3.     Issue of uniform guidelines on implementation of the Hon’ble Supreme Court judgement in N R Parmar case 4.         Finalisation of new IRS recruitment Rules It was informed by the Member(P) that due to some court cases pertaining to reservation, UPSC at present is not holding any DPC for promotion from Group-B to Group-A cadre. AIRF is not happy with Terms of Reference, writes letter to DoPT

All India Railwaymen's Federation is not happy with the Terms of Reference of the 7th Central Pay Commission as approved by Union Cabinet on 28.02.2014. AIRF has written a letter to the Secretary, DoPT in this regard on behalf of JCM staff side. AIRF stated that the Government had rejected its suggestions for either taking a decision in the matter of Interim Relief, Merger of DA bringing parity in pension between the past and present pensioners, covering the employees appointed on or after 01.01.2004 within the ambit of the Defined Benefit Pension Scheme, date of effect, settlement of the pending items in the National Anomaly Committee etc. or referring those issues to the Commission itself for an Interim Report. New OM issued by DOPT regarding inter se seniorty of promotees and DR

Interim Relief may be possible before general elections

No DA Merger, No increase in Retirement Age, but Interim Relief may be possible. The proposals for DA merger and increase of retirement age have not been considered by the central cabinet meeting held on Sunday evening. As such,  the proposals of Enhancement of Retirement age of Central Government Employees from 60 to 62 years and Merger of DA to basic pay may not be materialized now before General elections.
