Distribution of posts released


Congratulation to all employees of Income Tax family as CBDT finally released a order for distribution of posts in different cadre to different CCAs. Now it is expected that DPC  process for the promotion to all posts may be  initiated soon. However, detailed guideline is still awaited and the same may be issued any time.

Promotion to Pr. CCIT finalized and Order of Deaness Allownce issued

Today, Chairman, CBDT issued a message and congratulated all the 18 officers who have been elevated  to the grade of Principal CCIT in the Apex scale of Rs.80000/-.  Chairman also conveyed this day a Historic day for the Income Tax Department.

Now this is the term of rest of the employees of Income Tax Department who are in queue to promotion. It is expected that the notification for implementation may be issued before 31.03.2014. View the ITEF Circular here.

Order for revised rate of DA released.

Dearness Allowance payable to Central Government employees shall be enhanced from the existing rate of 90% to 100% with effect from 1st January, 2014.

The additional installment of Dearness Allowance payable under these orders shall be paid in cash to all Central Government employees.

The payment of arrears of Dearness Allowance shall not be made before the date of disbursement of salary of March, 2014.

ITEF's new circular on CR and other issues


The ITEF issued a circular after the meeting of PGRC which was held on 25th March, 2014 as scheduled. The outcome of the meeting on some of the agenda items is as under:

Cadre Restructuring : On the matter of Cadre Restructuring it is informed that there will not be reduction of posts in any charge and all charges will get the entitled additional posts. The proposal is now awaiting the final approval of the Finance Minister and in all probabilities the same will be notified by 31st March 2014. Recruitment Rules :  The Officials in the HRD is working on it and the Representative of ITEF have been asked to discuss the same with them.

Laptops to Inspectors : It is informed that there was some confusion in the DOE about various proposals viz. Replacement of laptops to Officers, Provision of Laptops to AO & PS etc. Now the proposal for Laptops to ITIs has been detached and resubmitted. The Directorate (infra) is pursuing the matter.

Mobile hands to all personnel:  This proposal is pending for approval from the Dept. Of Expenditure.

Enhancement of Local Travel Expenses of ITIs / NSs: The proposal approved by the Board and submitted to the IFU has been returned for further clarifications. The Clarifications and suggestions sought from the Chief Commissioners are awaited to further the matter. It is also informed that none of the CCsIT have respond yet, except the CCsIT of Bhuvaneswar, Hyderabad, Bangalore and Chandigarh..

Adv. Increment to Sr. TA / Stgr. on passing ITIs Examination:  The Member (P & V) directed the Directorate (V & L) to further examine the matter in the light of the favourable verdicts of various CA Tribunals.


Objection raised by ITEF on publication of communication on irsofficersonline: ITEF strongly objected to the publication of communications on service and other administrative matters through the official website of IRS Officers only, access to which is restricted to IRS Officers with pass word. The assurance for putting all such communication in the official website of the department i.e. www.incometaxindia.gov.in is given.

Status of Cadre Restructuring of IT and Dearness Allowance

As Finance Minister is currently out of the country and scheduled to return the capital tomorrow, the file related to Cadre restructuring of Income Tax may be placed on tomorrow or day after tomorrow. The notification in this regard may be issued soon.

On the other hand, all employees are eagerly waiting for Finance Ministry's Memorandum regarding revised dearness allowance w.e.f. January 2014 and the March month is going to its end. It is pertinent to mention here that in the last year, the approval for enhancement of DA was issued on 18th April.

Pension is a statutory right : Madras High Court

Upholding a Central Administrative Tribunal rpt Tribunal order, the Madras High Court today said right of government servants to receive pension is not a bounty and it is a statutory right conferred under the pension rules applicable from the date when the government servant was appointed, either on daily wage, temporary or permanent basis.

A Division Bench, comprising Justice N.Paul Vasanthakumar and Justice M.Sathyanarayanan was dismissing a writ petition filed by Ministry of Atomic Energy, and Indira Gandhi Centre for Atomic Research (IGCAR), Kalpakkam challenging the order passed by Central Administrative Tribunal.

In its order, the bench said it was an undisputed fact that the 16 petitioner employees had been appointed as casual labourers and subsequently conferred temporary status from December 31, 1999.
".. Merely because they have been absorbed permanently in the year 2005 in Group 'D' service, they cannot be denied of their statutory right," the court said.
Earlier CAT had allowed the original application filed by the 16 employees to extend the benefit of pension under old Pension Scheme, Central Civil Service (Pension) Rules, 1972 as they were granted temporary status with effect from December 31, 1999 on conditions, among others , that 50% of their service rendered under temporary status would be counted for the purpose of retirement benefits after their superannuation.

This was challenged by IGCAR, stating that persons who joined in service on or after January 1, 2004 were governed by the new pension scheme. The CAT rejected it following which IGCAR filed the present petition.

IGCAR had engaged 50 Casual labourers for cleaning and assisting Technicians and Scientists Carrying out the task in various laboratories of IGCAR. Out of 50, 34 casual labourers were regularized prior to January 1,2004.

The court said a person already in service either as contingent staff or temporary staff continuously and absorbed in permanent establishment on or after Jan 1,2004 cannot be termed 'new entrant' into service. The new pension scheme can be applied only to persons appointed for the first time as casual or temporary or permanent employee on or after January 1,2004.

The bench clarified that the 50 casual employees appointed by the IGCAR being a class, there cannot be any classification within them, subsequently made as temporary employees and absorbed as Group 'D' employees.


While quoting Supreme Court Judgements the bench said these 16 employees cannot be treated as 'Fresh appointees' for the purpose of applying new pension scheme and upheld the order of CAT while dismissing the petition from IGCAR.

Closing of Central Government Offices in connection with general elections 2014.


In connection with the general elections to the Lok Sabha and State Legislative Assemblies of Andhra Pradesh, Odisha & Sikkim and Bye Elections to Legislative Assemblies of some States, scheduled to be held in 2014, the relevant offices / organizations shall remain closed on the day of poll in the notified areas where general elections to the Lok Sabha and State Legislative Assembly are scheduled to be conducted.

In connection with bye-election to State Assembly, only such of the employees who are bona-fide voters in the relevant constituency should be granted special casual leave on the day of polling. Special Casual leave may also be granted to an employee who is ordinarily a resident of constituency and registered as a voter but employed in any Central Government Organizatlon / Industrial Establishment located outside the constituency having a general / bye-election.

Agitation of ITEF, Delhi Circle Postponed

After announcement of agitational program on the matter of implementation of Cadre Restructuring of Income Tax Department, now the JCA Delhi has decided to withhold the agitation starting from 19.3.2014 till further information.
As per the information gathered, the Member (P & V), CBDT has called the ITEF, Delhi Circle to meet and discuss the matter on 18.3.2013. In the meeting she has intimated that official meeting with the Secretary (Revenue) has been fixed for 19.3.2014 and assured that the Board is making all out efforts to expedite the implementation of the Cadre Restructuring and requested to postpone the agitation till the outcome of the said presentation with the Revenue Secretary. It is also informed that the assurance given by the Member (P & V), CBDT is conveyed in writing to the ITEF, Delhi Circle through the office of the CCIT (CCA), New Delhi.

Due to General Election announced by the Government during the month of April and May, 2014 and also the re-examination of Combined Graduate Level Examination 2013 at seven Centers/Cities, the Combined Graduate Level Examination, 2014 is postponed. The CGLE exam is tentatively scheduled to be held after June’2014.

ITEF Delhi Circle is on the way of agitation


A General Body meeting of the INCOME-TAX EMPLOYEES FEDERATION, DELHI CIRCLE & INCOME-TAX EMPLOYEES FEDERATION, 'Gr. D 'DELHI CIRCLE, NEW DELHI was held on today i.e. 14.3.2014 during lunch hour to chalk out the agitational programme on the issue of Cadre Restructuring implementation.

In the meeting it has unanimously been resolved that if the notification of posts allocation will not be issued before 19th March 2014 the following agitational programme would be embark upon wef 03/19/2014:

1. Walkout from 12.00 PM onwards on 19.3.2014.
2.Mass Dharna at C.R. Building w.e.f. 11.00AM on 20.3.2014 to 5.00 PM on 21.3.2014.


3.It has been further resolved that if no action in this regard has been taken till 21st March 2014, then the General Body Meeting of the ITEF, Delhi Circle will again be called on 21.3.2014 to review and accelerate the agitational programme by adopting measures like hunger strike or indefinite strike etc.

ITGOA wrote letter to CBDT to issue uniform guidelines in NR Parmar case

ITGOA wrote letter to CBDT pressing for issuance of a guidelines for uniform implementation  of Hon'ble Supreme Court's judgement in the case of Union of India Vs. N. R. Parmar and DOPT's O.M dated 04.03.2014, across the various charges in order to remove the anomaly that exists in various charges in the seniority list of Inspector of Income Tax. This has become necessary for conducting the review DPCs in cadres of Income-tax Officers to determine relative seniority at National level and also to reduce the ongoing litigation as well as future litigation.

ITGOA in its letter also stated that there is urgent need to attend this problem as the promotions in all cadres are stayed by judicial authorities, which is jeopardizing the career prospects of the members of the Association.

AIRF writes for enhancement in the rates of various allowances by 25% consequent upon DA crossing 100%

All India Railwaymen's Federation (AIRF) has sent a letter to the secretary(E), Railway board regarding enhancement in the rates of various allowances by 25% consequent upon DA crossing 100%. Read the contents of letter here:

"The VI CPC in their report had recommended that certain allowances, viz. Children Education Allowance, National Holiday Allowance, Daily Allowance, Washing Allowance, Breakdown Allowance, Special Compensatory Allowance, Cycle Maintenance Allowance, Fixed Conveyance Allowance, Road Mileage Allowance, Special Allowance to various categories of staff etc. etc., should be increased by 25% whenever Dearness Allowance crosses 50%, and this recommendation was duly accepted by the Government of India.
Based on the above recommendation of the VI CPC, these allowances have since been enhanced by 25% w.e.f. 01.01.2011, i.e. from the date, Dearness Allowance having been crossed 50%.

Now, Dearness Allowance has crossed 100% w.e.f. 01.01.2014, there is, therefore, gross justification that the above allowances be further enhanced by additional 25%, as Dearness Allowance has again crossed the value of 50% after enhancement of these allowances wef01.01.2011.


The Board are, therefore, requested to issue necessary instruction to this effect an early date"

ITGOA's Circular on development on various issues after meeting with the authorities in the CBDT and meeting with ITEF


The newly elected CHQ of ITGOA met the DGIT and other authorities in HRD on 04/03/2014 and met the Chairman, Member(P) and other authorities in the CBDT on 05/03/2014 and discussed on following issues

1.        Issue relating to placement of 2001 batch in NFSG
2.        Promotion from ITO to the ACIT cadre : 
3.   Issue of uniform guidelines on implementation of the Hon’ble Supreme Court judgement in N R Parmar case
4.        Finalisation of new IRS recruitment Rules

It was informed by the Member(P) that due to some court cases pertaining to reservation, UPSC at present is not holding any DPC for promotion from Group-B to Group-A cadre. However, she assured that UPSC shall be requested to hold the DPC at the earliest.

Lunch time demonstration on 12.03.2014 : JCA, ITEF & ITGOA

JCA, ITEF & ITGOA will protest against the callous attitude of CBDT on implementation of cadre restructuring of Income Tax. It is decided by JCA to protest by lunch time demonstration on 12.03.2014 at all CCIT and CIT stations.

“Dear Comrades
You are aware that the Central Board of Direct Taxes has finalised and approved the allocation of 20751 additional posts sanctioned by the Government for restructuring of the Department. The Board, according to the signing off message on the wee hours of the Chairpersons superannuation, has sent the proposal to the Hon'ble Finance Minister for his approval on 28th Feb. In 2014 . The present position, it is learnt is that the same may be returned within a few days after approval for notification and implementation.

            The JCA, representing about 95% of the personnel in the Department and shouldering all the core responsibilities of completion of assessments, Revenue Collection, widening tax base etc. came to know the above development from the Website. In this context you may recall the ITEF Circular No. 38 dated 18.01.2014, wherein we have detailed the discussion with the Member (P & V) and other officials had with the representatives of JCA on 16th and 17th January, 2014 on the implementation of Cadre Restructuring and allocation of post. The focus of discussion in that meeting was to find out a solution and settlement of the differences arising out of the two reports made by the Committee constituted by the Board (Sub-Committee No. 1 and Core Committee) and the proposal of the Income Tax Employees Federation on allocation of posts. As intimated in the above circular, the meeting was concluded on the basis of an assurance that the Board will come out with its stand as regards the basis of allocation of posts and other matters and revert to the leaders of JCA for discussion before finalisation. In yet another meeting the representatives of ITEF had with the Chairperson, Member (P & V) & other officials on 20th February, 2014, the assurance of discussion with us as soon as the CBDT finalise its proposal was reiterated. On 21st February, 2014 also, the Member (P & V), while addressing the Inaugural Session of the ITGOA Biennial General Meeting at Chennai, assured the entire delegates and leaders of both the organisation that the basis of allocation of posts is being worked out and will be subjected to discussion with the JCA before finalisation. In its letter dated 24th February, 2014, the ITGOA, again requested the Chairperson to cause discussion with the Representative of JCA before finalisation.

            The above action on the part of the CBDT authorities is clear infringement of understanding and violation of principles of bilateral agreements. This attitude of the CBDT in totally ignoring the recognised organisation which represent the majority of the personnel in the Department and duplicity of words deserve strongest condemnation. The Leaders of the JCA met in New Delhi today and took stock of the situation arising out of the callous attitude of the CBDT in dealing with the aspirations of the Personnel, decided to lodge our protest in the form of a Demonstration and also to bring our protest to the knowledge of the authorities by sending a savingram. Therefore, we request the Circle / Unit leadership to stage this protest Demonstration during the lunch recess on 12th March, 2014 at all CCIT and CIT Stations and adopt and send the Savingram to the Chairman, CBDT in the enclosed format.”

AIRF is not happy with Terms of Reference, writes letter to DoPT


All India Railwaymen's Federation is not happy with the Terms of Reference of the 7th Central Pay Commission as approved by Union Cabinet on 28.02.2014. AIRF has written a letter to the Secretary, DoPT in this regard on behalf of JCM staff side. AIRF stated that the Government had rejected its suggestions for either taking a decision in the matter of Interim Relief, Merger of DA bringing parity in pension between the past and present pensioners, covering the employees appointed on or after 01.01.2004 within the ambit of the Defined Benefit Pension Scheme, date of effect, settlement of the pending items in the National Anomaly Committee etc. or referring those issues to the Commission itself for an Interim Report. At last of this letter AIRF requested to convene the meeting of Standing Committee of National Council (JCM) to discuss the issue, so as to make amendments to the Terms of Reference finalized by the Government.

New OM issued by DOPT regarding inter se seniorty of promotees and DR

The matter has been examined by DOPT in pursuance of Hon’ble Supreme Court Judgment on 27.11.2012 in the case of N.R. Parmar vs. UOI & Others in consultation with the Department of Legal Affairs and it has been decided, that the manner of determination of inter-se-seniority of direct recruits and promotes would be as under:
a)     DoPT OM No. 20011/1/2006-Estt4D) dated 3.3.2008 Is treated as non­existent/withdrawn ab initio;
b)     The rotation of quota based on the available direct recruits and promotees appointed against the vacancies of a Recruitment Year, as provided in DOPT O.M. dated 7.2.1986/3.07.1986, would continue to operate for determination of inter se seniority between direct recruits and promotees;
c)     The available direct recruits and promotees, for assignment of inter se seniority, would refer to the direct recruits and promotees who are appointed against the vacancies of a Recruitment Year;
d)     Recruitment Year would be the year of initiating the recruitment process against a vacancy year;
e)     Initiation of recruitment process against a vacancy year would be the date of sending of requisition for filling up of vacancies to the recruiting agency in the case of direct recruits; in the case of promotees the date on which a proposal, complete in all respects, is sent to UPSC/Chairman-DPC for convening of DPC to fill up the vacancies through promotion would be the relevant date.
 f)      The initiation of recruitment process for any of the modes viz, direct recruitment or promotion would be deemed to be the initiation of recruitment process for the other mode as well;
g)     Carry forward of vacancies against direct recruitment or promotion quota would be determined from the appointments made against the first attempt for filling up of the vacancies for a Recruitment Year;
h)     The above principles for determination of inter se seniority of direct recruits and promotees would be effective from 27.11.2012, the date of Supreme Court Judgment in Civil Appeal No. 7514-7515/2005 in the case of N.R. Parmar Vs. UOI & oths

i)     The cases of seniority already settled with reference to the applicable interpretation of the term availability, as contained in DoPT O.M. dated 7.2.86/3.7.86 may not be reopened.


Clarification on fresh attempts and age relaxation in Civil Services Examination



For Civil Services Examination, the existing position in respect of number of attempts and maximum age limits for various categories of candidates and the changes as approved in number of attempts & age-limits consequent to providing two additional attempts would be as under:-

Interim Relief may be possible before general elections

No DA Merger, No increase in Retirement Age, but Interim Relief may be possible. The proposals for DA merger and increase of retirement age have not been considered by the central cabinet meeting held on Sunday evening. As such,  the proposals of Enhancement of Retirement age of Central Government Employees from 60 to 62 years and Merger of DA to basic pay may not be materialized now before General elections. But there is a possibility of Interim Relief before elections by the Pay Commission.
