New Income Tax Rules – Submission of false Aadhaar number may be fined Rs. 10,000

As it is well known that the income tax department has allowed Aadhaar card holders to use the biometric id number in lieu of the Permanent Account Number (PAN). But as per new provision of Income Tax, fine of Rs. 10,000 may be levied in case of wrong Aadhar Number. As per the latest amendments in the Finance Bill 2019, not only allowed people to use Aadhaar in lieu of PAN but also introduced a penalty for giving a false Aadhaar number. However, the new penalty rules are applicable only in cases where you are using Aadhaar in lieu of PAN and where quoting PAN is mandatory according to the income tax department rules. It is well known that although Aadhaar is issued by the Unique Identity Authority of India, yet the fine is not imposed by UIDAI but by the income tax department. Under Section 272B of the Income Tax Act, 1961, the department can impose a penalty in case of default in complying with provisions relating to PAN, i.e., failure to obtain, quote, or authenticate PAN.

DA will be 100% w.e.f. January 2014

Now it is very clear from the AICPIN issued today that DA will be 100% w.e.f. January 2014. Decline in AICPIN for December, 2013 vanished the expectation for crossing the DA from 100%. Government Decides to Keep in Abeyance the Decision to Change the Procedure for Pan Allotment till Further orders

The Central Board of Direct Taxes (CBDT) has decided to keep in abeyance the decision to change the procedure for PAN allotment till further orders. Accordingly, the operation of Circular No. 11 dated 16.01.2014 issued to PAN service providers has been directed to be put on hold till further orders. In the meantime, the old procedure of PAN application and allotment shall continue.

DA Merger with Pay : AIRF puts pressure on government

Struggle is still going for the merger of Dearness Allowance with pay. JCA, WB letter to Rev Sec seeking intervention against discrimination regarding allocation of posts

After the recommendation of Core Committee for allocation of posts, JCA West Bengal sent a letter to Revenue Secretary seeking intervention against discrimination made with West Bengal charge. With regard to WB region it is pertinent to mention here that Core Committee in its report reduced the number of posts of Principal CIT, Addl CIT, ACIT/DCIT and ITO from the recommendation of Sub-committee no.-1. Allocation of posts on implementation of Cadre Restructuring of Income Tax Deptt.

Friends, as intimated earlier, the core committee has received the report of Sub Committee No.1 on jurisdiction and deployment of posts on 30.11.2013. A fter minor changing, t he core committee has submitted its report to the board on 13.01.2014 for approval. Meetings on Cadre Restructuring dated 16.01.2014 and 17

Meetings on cadre restructuring with ITEF and ITGOA convened by Member (P&V), CBDT were held on 16.01.2014 and 17.01.2014. As stated earlier the main subject of meeting was different yardsticks adopted by sub-committee -1 and core committed and that of the ITEF. ITEF cleared its views on formula proposed by them regarding allocation of posts. Meeting was concluded without any final assurance except assurance of Member(P&V) to discuss the outcome in the board. Merger of 50% DA soon

Merger of 50% DA soon be considered by Central Government. As it is very clear from AICPIN that DA may cross 100% w.e.f. January 2014, the merger of 50% DA may be announced before declaring of enhancement of DA which is due w.e.f. 01.01.2014. Withdrawal of Tax-Exemption in Case of Four Cricket Associations The Income Tax authorities have looked into the affairs of the four cricket associations, namely Saurastra Cricket Association, Baroda Cricket Association, Kerala Cricket Association and Maharashtra Cricket Association and have found that these cricket associations were engaged in certain activities which were considered commercial in nature in view of the amended provisions of Sec 2 (15) of the Income Tax Act, 1961. Consequently, the scrutiny of assessments in these cases has resulted into the withdrawal of tax-exemption. Past assessments in these cases have also been reopened by the Department to examine the correctness of their claim for income tax exemption during the periods concerned. Cadre Restructuring of Income Tax

There is great disappointment among employees of Income Tax due to delay in implementation of Cadre Restructuring. After passing more than 7 months, there is still no strong assurance from Board or service associations for early implementation of Cadre Restructuring. It is learnt that JCA-WB has started agitation and non-cooperation on the issue of allocation and ITGOA(UP) has raised on objection on the reduction of posts in the grade of ACIT in their region. Similarly, grievance is raised by ITGOA-Karnatka region that they stand 3rd in terms of revenue collection while 9th in terms of manpower. They all are claiming that they have not got their rightful on allocation of posts. It is also learnt that CBDT is now preparing to issue a clarification on NR Parmar case. The clarification in the regard may be issued soon.

12% growth in Direct Tax Collection during April-December

According to Finance Ministry, there is overall growth of 12.33% in Direct Tax Collecion in the current fiscal year till date in the comparison of same period last year. There is growth of 9.35% in gross corporate tax collection while 18.5% in gross personal income tax collection. There is growth of 12.53% in net direct tax collection.
