New Income Tax Rules – Submission of false Aadhaar number may be fined Rs. 10,000

As it is well known that the income tax department has allowed Aadhaar card holders to use the biometric id number in lieu of the Permanent Account Number (PAN). But as per new provision of Income Tax, fine of Rs. 10,000 may be levied in case of wrong Aadhar Number. As per the latest amendments in the Finance Bill 2019, not only allowed people to use Aadhaar in lieu of PAN but also introduced a penalty for giving a false Aadhaar number. However, the new penalty rules are applicable only in cases where you are using Aadhaar in lieu of PAN and where quoting PAN is mandatory according to the income tax department rules. It is well known that although Aadhaar is issued by the Unique Identity Authority of India, yet the fine is not imposed by UIDAI but by the income tax department. Under Section 272B of the Income Tax Act, 1961, the department can impose a penalty in case of default in complying with provisions relating to PAN, i.e., failure to obtain, quote, or authenticate PAN.

All Central government employees will soon be expected to communicate through the National Informatics Centre (NIC) email ID, a union minister said on Monday adding that the government was chalking out a plan in this regard. Minister of State for Communications Milind Deora told reporters that his department is working on a new email policy which will address this issue, among others. "Once this is ready, then all government officials will have to communicate only through NIC email id," he said. "After this, the issue of cyber security can be addressed on a single platform as NIC is taking care of e-governance programmes of the Centre," said Deora. Like ITian India on Facebook

It is learnt that ITGOA has sent reports of all 7 sub committees to all the members nominated by association to these sub-committees by email. The association also requested to submit their detailed comments within 4 days i.e. whether the report is conforming to the suggestions of ITGOA or not. if not, what are the variations? Circular of ITEF dated 13.12.2013 on Cadre Restructuring and other issues

Today ITEF issued a circular regarding Secretariat meeting held on 12.12.2013 on Cadre Restructuring, NR Parmar judgement and other issues.  Cadre Restructuring : As stated by ITEF, the basis adopted for allocation of the posts by the sub-committee was not on a realistic basis and far from practicality.  ITEF further stated that the Committee has not accepted any of the parameters suggested by the federation.  The allocation made and submitted by ITEF on the basis of the formula adopted in the Working Committee Meeting was totally rejected by the Sub-Committee.  Read related post on the matter :- Click here Read the full contents of circular of ITEF below : Like ITian India on Facebook

Implementation of Cadre restructuring of Income Tax and NR Parmar case judgement

It is learnt that some members of the core committee and some associations are not happy with the report of sub-committee for allocation of posts and jurisdiction. This is the reason for delay in finalization of allocation of post and jurisdiction. It is also learnt that next meeting of core committee is scheduled on Monday i.e. 16.12.2013. 7th Pay Commission News : Process to constitute the 7th CPC initiated...........

Process to Constitute the 7th Central Pay Commission Along with Finalization of Its Terms of Reference, The Composition and Time frame Initiated The Government has initiated the process to constitute the 7th Central Pay Commission along with finalization of its Terms of Reference, the composition and the possible time frame for submission of its Report. The date of effect thereof will be known once the Report is available. Key points regarding Cadre Restructuring of CBEC

As the cadre restructuring of CBEC is approved by Union Cabinet on 05.12.2013, here are some key points regarding Cadre Restructuring of CBEC: 1.      A total of 18,067 additional posts will be created. Out of this, 989 posts will be for Group ‘A’ officials such as Chief Commissioner, Commissioner and Assistant Commissioners. The remaining will be for Group B, C and other category consisting of Superintendents, Inspectors, Havaldars and field staffs. Currently, the sanctioned strength of CBEC is 66,808. 2.      It has also been decided to create 2,118 temporary posts for five years. 3.      The whole exercise is expected to be completed in the next two years. 4.    Creation of additional posts will involve an expenditure of approximately Rs 774 crore, it will help in collecting around Rs 68,000 crore annually. Present position of Cadre Restructuring of CBEC

It is learnt that the Cabinet Note relating to approval of cadre restructuring proposal of CBEC  has been finally prepared/ approved  on 26.11.2013 by Cabinet Secretary. Implementation of Cadre Restructuring of Income Tax: Discussion in Video Conference on 28.11.2013

Today Video Conference of CBDT with CCsIT and DGsIT has been held on scheduled time. All the predetermined issues including issue of Cadre Restructuring were discussed. CBDT informed that reports of all subcommittees except Subcommittee for allocation of posts and jurisdiction have been received. It is also informed that this subcommittee will submit the report tomorrow i.e. 29.11.2013. Pay commission could be notified over the next two months

Sources said that the the pay commission could be notified over the next two months or so, well before the model code of conduct for the general elections kicks in. Also, the  Center  is expected to give the panel enough time to prepare its report in the hope that the government would be a lot more comfortable vis-a-vis the fiscal deficit by the time the panel submits its report.

New rule lowers HRA exemption claim limit..........

The central government has lowered the exemption limit for reporting the rent received. Salaried taxpayers claiming HRA exemption and paying a rent of over Rs 1 lakh per year have to give landlord's PAN (permanent account number). Till now, if the total rent paid was less than Rs 15,000 a month there was no need to submit the landlord's PAN details. The new rule effectively lowers the rent limit from Rs 15,000 a month to Rs 8,333 per month for claiming HRA exemption without making any disclosures. Though incurring actual expenditure on payment of rent is a pre-requisite for claiming deduction under section 10(13A) of the I-Tax Act, it has been decided as an administrative measure that salaried employees drawing HRA up to Rs 3,000 per month will be exempted from production of rent receipt. DTC Bill in Winter Session : Provision of Fourth slab may introduce.......

The finance ministry on Wednesday said it is finalizing the official amendments to the Direct Taxes Code (DTC) Bill so that it could be taken up in the winter session of Parliament beginning 5 December. “We are working on the DTC Bill and want to bring it as soon as possible,” revenue secretary Sumit Bose said on the sidelines of a Confederation of Indian Industry (CII) summit. The finance ministry is currently working on the official amendments to the DTC Bill which was tabled in Parliament earlier.

Current position of Cadre Restructuring of CBEC

       The cabinet note for cadre restructuring has been signed by the FM. Income Tax exemption limit will be raised to 3 lakh, Introduction of Super rich Category

Well, Ministry of Law and Justice has approved the proposal to raise annual income tax exemption limit from 2 lakh to 3 lakh, reports DB correspondent. The Direct Tax Code (DTC) draft will now be sent to Cabinet for approval. Thereafter, the approved draft will be introduced in Parliament. Objection raised by DOPT on Cadre Restructuring Proposal of CBEC : Financial Express

The Department of Personnel and Training (DoPT) has raised objections to the cadre restructuring proposal of the Central Board of Excise and Customs (CBEC), delaying a resolution to the acute manpower crisis affecting the indirect tax administration, which is struggling to collect 20% more revenue from central excise, customs and service tax this year from a year ago. CBEC has a revenue target of Rs 5.6 lakh crore this fiscal, 46% of the Centre's gross tax revenue. The annual growth in indirect tax collections has come down sharply since 2011-12. It is reckoned that in addition to the economic slowdown, the CBEC's human resource crunch has also hit the collection drive. CBEC's demand for more secretary-level posts and field officers to bolster its revenue collection drive is now likely to be referred to a committee of secretaries or to a group of ministers for further review instead of being placed before the cabinet for approval as expected earlier. COC meeting of all associations of CBDT & CBEC regarding 7th Pay Commission

7th Pay Commission for Central Govt employees is going to be set up soon. It is required to submit a memorandum before 7th CPC for awarding appropriate pay and other benefits to the officers / staffs of department of Revenue. Therefore a meeting of COC of all associations of CBEC & CBDT is going to be held n 23.11.13 at New Delhi to discuss about submission of such memorandum.

Expected DA from January 2014 may be increased by 11% for Central Govt. Employees & Pensioners

All-India CPI-IW for September, 2013 rose by 1 point and pegged at 238. According to this increase Dearness Allowance for Central Government Employees & Dearness Relief for CG Pensioner confirmed to be 100% from January, 2014. This increase and present economic scenario are making less possibility that the DA/DR for Jan, 2014 may not cross 100% or may stop at 99%. ITEF, AP Circle's Circular on Cadre Restructuring.

 ITEF, ANDHRA PRADESH CIRCLE, HYDERABAD circulated following details on All-India Working Committee of the ITEF held at Jaipur on 19 & 20 th October, 2013: The following issues were discussed in the all-India Working Committee meeting of the ITEF held at Jaipur on 19th and 20th October 2013. It was stated that the sub-committee of CBDT has agreed upon the following issues which the ITEF has time and again demanded: 1. The sub-committee of CBDT on cadre-restructuring at all-India level has discussed the issue of conversion of staff car drivers into TA / NS and agreed in principle. Proposals will be sent for making modifications in the recruitment rules of TA and NS to this effect. 2. The sub-committee of CBDT is also actively considering the absorption of daily rated workers in the cadre restructuring exercise itself. A positive decision is expected because many new MTS posts will be created in cadre restructuring.

Charge-wise allocated strength in various grades in the income tax department as on 31.03.2009

There is no information received from any reliable sources regarding finalization of Region wise allocation of posts due to Cadre restructuring 2013 of Income tax department. Only information received from the side of ITEF about the criteria for region wise distribution of posts. The decisions of Central Working Committee Meeting held at JAIPUR on 19-20 Oct. 2013 and decisions.

The Central Working Committee Meeting was held at Jaipur (Rajasthan) as scheduled on 19th and 20th October, 2013. Following agenda items are discussed. Outcomes of the Meeting on 7th Pay Commission held on 24.10.2013

    Central Government invited the National Council Standing Committee members for discussing the Terms and reference for the 7th Central Pay commission. A meeting was held under the Chairmanship of Secretary, DOP& T on 24.10.2013 at 1500 Hrs at North Block. Staff side Members, National Council JCM  Standing Committee, have attended this Meeting. On behalf of Staff side the fallowing suggestion has been given to the Central Government  Government of India should come out with their proposal on Terms and Reference and then Staff side will    give their proposal.  All anomalies pending including MACP to be settled.  One Labour leader to be included in the commission.  All pending cadre Review proposals should be delinked from 7th CPC. Order for payment of Productivity Linked Bonus to all eligible non-gazetted Railway Employee

As the Union Cabinet approved the proposal of the Ministry of Railways for payment of Productivity Linked Bonus (PLB) equivalent to 78 days wages for the financial year 2012-13 for all eligible non-gazetted railway employees,  PLB equivalent to 78 days wages will be paid as a special case considering the good financial performances which is expected to motivate employees. Cadre Restructuring of Income Tax Department: ACRs/APARs of Income Tax Officers

Directorate of Income Tax, New Delhi directed some of the CCsIT(CCA) to take up necessary exercise for updating all the deficient ACRs/APARs of Income Tax Officers till the end of F.Y. 2011-12 in their region on top priority. CBDT also send the list of such ITOs which is as under. CBDT also directed to ensure that complete ACRs/APARs or ‘No Report Certificate’ of these officers may be sent to Directorate latest by 10.10.2013.

Cadre Restructuring of Indian Railway : Approved by Ministry of Railways

Railway ministry approved upgradation of 3335 posts from Group ‘C’ to Group ‘B’. It is approved by the Ministry of Railways and the proposal has been sent for the clearance of Ministry of Finance. About 3.5 lakhs employees are expected to be benefited on account of cadre restructuring all over Indian Railways. The Cadre Restructuring Committee (CRC) meeting had taken place from 2010 and the last CRC meeting had taken place on 22 nd February, 2013. NFIR has issued a press statement regarding it. 164 Officers have been promoted as Joint Commissioner of Income Tax on ad-hoc basis. List of the officers are as under: The promotion shall effect from the date of joining the post of JCIT. The promoted officers are retained at the same CCIT(CCA) region. They will be considered for transfer out of the region on promotion as per the transfer guidelines at AGT 2014 in April May, 2014.
